These Terms of Purchase and Refund Policy apply to all purchases you make from us via our website, over the phone, at a live event, or in any other manner.

Sales of Our Programs And Services

Our services—including but not limited to the design, setup, hosting, and maintenance of websites, funnels, and/or online course or membership portals—are aimed at helping organizations deliver their content effectively. While we work diligently to provide professional and functional platforms, we cannot and do not guarantee any specific outcome for your organization, ministry, or business.

You are solely responsible for the content you provide, the way your members or participants engage with it, and any outcomes that result from use of the platform. Any testimonials, case studies, or examples we provide are not guarantees of your results but are intended only as illustrations of what some clients have experienced.

Refunds

Due to the custom nature of our services and ongoing hosting commitments, we do not offer refunds on any of our products or services.

Ongoing Hosting & Subscription Fees

If you choose to host your course portal or membership site with us, the following terms apply:

Recurring Billing – Hosting and maintenance fees are billed on a recurring basis (monthly, quarterly, or annually, as specified in your agreement). By purchasing hosting, you authorize us to automatically charge your payment method for each billing cycle.

Non-Payment – If payment is declined or not received by the due date, we reserve the right to suspend or terminate hosting services until the account is brought current.

Cancellation Policy – You may cancel your hosting subscription at any time by providing written notice at least 30 days prior to your next billing date. No refunds (full or prorated) will be given for unused time after cancellation.

Data Access After Cancellation – Upon cancellation or termination, we may provide a reasonable opportunity for you to export your data. However, all platform files, design framework, and hosting environment remain the property of ClearCourse Agency.

Service Level & Support Disclaimer

We strive to provide reliable hosting and responsive support. However, we do not guarantee uninterrupted or error-free service. Hosting uptime, performance, and platform features are subject to the capabilities and limitations of our third-party providers.

Support is provided as outlined in your service plan. Response times and resolution times may vary based on issue complexity and provider involvement.

Third-Party Platform Disclaimer

Our hosting services are built on and depend upon third-party platforms, including but not limited to Go High Level. You acknowledge and agree that:

We have no control over the functionality, availability, or ongoing development of these platforms.

Service interruptions, outages, feature removals, bugs, or policy changes by the third-party provider are outside of our responsibility and may affect your account, website, or portal.

We are not liable for any loss of revenue, membership, donations, sales, or goodwill resulting from third-party platform failures or limitations.

If a third-party provider discontinues or materially changes its services, we will make reasonable efforts to provide alternatives, but we cannot guarantee continuity.

Limitation of Liability

To the maximum extent permitted by law, in no event shall ClearCourse Agency, its owners, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, profits, data, or business opportunities.

Our total liability for any claim arising out of or relating to your purchase or use of our services shall not exceed the total amount you paid us for those services in the three (3) months immediately preceding the claim.

Name and Likeness Permission & Release

If you attend an event, training, consultation, or live/online event with us, you give us permission to audio and video record and photograph you, and to use your name, likeness, audio, video, and photograph of you for any purpose, in any manner, in any medium, now known or hereafter developed, at the discretion of us for legitimate business purposes and/or marketing efforts. You irrevocably grant us these rights without further payment and without the option for you to review the final product.

Payment Plans

If you purchase a service utilizing a payment plan, you are responsible for all agreed-upon payments. If payments are not timely received, your access to services (including ongoing hosting) may be suspended or terminated. No payments will be refunded, either in part or in full.

If you use a third-party lender—even one suggested by us—you agree that you will perform your own due diligence and further acknowledge that we have no knowledge of or responsibility for any lender and do not offer financial advice.

When You Buy from an Affiliate

We make no representations of any kind as to the products and services of any of our affiliates. Any purchase made through a third-party affiliate is subject to the affiliate’s own terms and conditions.

Force Majeure

We are not responsible for failure or delay of performance if caused by an act of God; hostility; telecommunication outage; government restrictions; a pandemic; or any other event outside of our reasonable control.

Licensing and Use of Services

All portals and platforms created and hosted by ClearCourse Agency remain the intellectual property of ClearCourse Agency, unless otherwise explicitly stated in writing. Clients receive a license to use the platform for their own organizational purposes but may not resell, replicate, or transfer our proprietary setup or hosting services to third parties without permission.

Unauthorized sharing of access credentials, duplication of our design framework, or use of our hosting environment for purposes outside of the agreed scope is strictly prohibited. We reserve the right to suspend and/or cancel access at our sole discretion if there is evidence of misuse or unauthorized use. No refunds, in whole or in part, will be given in such cases.
